The biological process of reproduction in any organism is determined purely by the nature or what some people may prefer to call as God .That means,the process is not regulated by any man-made law and is totally under the control of the nature .Sometimes, what is not acceptable in our human view takes place in the reproduction process of some organisms but we have no say in it.After all ,we are also part of the creation.An interesting example that is readily available is from the world of the scorpions.
The female scorpions usually eat away the males after the mating process is over .It is indeed pathetic to note that the male scorpion has to pay a heavy price of its precious life just for the joy of mating with the female once!Yes,it is fully eaten/consumed by the female just after the mating !In human angle,the female becomes a widow on the first night itself !There are many such strange behaviour patterns noted among various creatures during the reproduction process,in the animal world.
Coming to the human world, the human reproduction process also is predefined by nature and the roles of the male and the female are clearly cut for it.The team leader for the human reproduction process is the male who ,normally approaches the female, in an aggressive manner, for the purpose of reproduction.The aggressive nature of the male in the reproductive process is signified by the aggressive nature of the sperms produced by the male and the passive nature of the female is signified by the patient waiting of the ovum produced by the female in the uterus.As soon as the semen is released in the vaginal canal through sexual intercourse ,the sperms compete with each other and swim fast to reach their goal,that's the fertilising of the solitary ovum, waiting eagerly for the winner sperm.Towards achieving this mission of the winner sperm fertilizing the solitary ovum in the uterus,the man and woman has to do lot of pre-event moves and manoeuvres !
The objective of this analysis is to figure out what are the natural moves of the male and the female in the human reproductive process and what are the unfortunate legal restrictions in India, that come in the way of these nature's moves: It is to be noted that ,though the male takes forward the reproductive process, it is the female which inspires the male to initiate the process,by suitable seduction moves that are knowingly or unknowingly done by it.So, let us start our analysis with the female first.
So, here is a list of moves done by the female and the legal restrictions on them,with respect to it,if any, in the Indian law. FEMALE MOVES
- As we are all aware,in the pollination process, nature has created the flower beautiful enough to attract the honey bees ,who go around from flower to flower collecting the pollens and depositing it on the other flowers.Like wise, in the human reproduction process the female is created beautiful enough to attract the male for the sexual intercourse.The female is designed beautiful to attract the male strongly ,strangely without its knowledge or conscious effort. LEGAL POSITION -The Indian law does not and cannot legally prohibit females attracting the males and inviting/inciting them for sexual intercourse,either consciously or unconsciously.So, the females are free to attract or incite any male by their beauty and are not legally prohibitted/punished for this act of initiating a strong sexual move.
- In the animal world, normally there is a defined season for mating and reproduction .The animals usually get the sexual feeling only during the heat period of the season and not at all times.However,it's not so in the case of human beings.The process happens throughout the year, in almost all seasons but maybe more intense during some specific seasons .Hence,the female continues attracting the male during all the seasons throughout the year. The human females attract the males in all positions,that's like standing, sitting,walking,sleeping,yawning ,coughing,smiling ,not smiling, rude, angry and surprisingly ,even while slapping a male!They can walk in style or dance beautifully to attract the male.The voice of the female sounds sweet and attractive to the male and so, if they talk or sing, it attracts the male all the more!They attract in dress and much more without dress! While the natural position is so,the women do something extra too!They choose to sharpen their attracting skills consciously through mild exposure of the sexually attractive parts of their body like the thighs,breasts and the buttocks .They wear skin colour short dress that shows them like almost nude and bikini dress to attract at the first glance itself. As if this is not enough,they also resort to cosmetics, makeups and developing specific style of walking,talking etc.to feed the burning latent spirit of lust in the men.Women often provide situations where they induce the feeling of sex in a man in public spaces ,without their knowledge or conscious consent. Here here the man who is just standing behind the girl will be sexually excited by the touch of the buttocks of the girl in front while the man standing in front of the girl will be aroused sexually by the touch of her breasts on his body!Whatever be the helpless situation, it can't be denied that the woman provides the stimuli for the sexual act ,willingly or unwillingly ! Her willingness does not count in this situation.The sexual act happens automatically induced by the situation. How far can a man identify a woman just by silhoutte and walking gait ?Studies in this regard suggest that a female can attract a male as far as 300 metres away !If the view is uninterrupted ,a female can attract just through her silhoutte and the gait of walk !

Now,let us take a look at the legal position of these sexual acts stimuli done by the females.LEGAL POSITION - The present Indian law does not,in any way, prohibit women from: *inciting,* seducing, *honey trapping,*attracting by exposing sexuallly attractive parts,*sexy costumes*making sexually inviting gestures by winks, flirting lip bites,*sandwich inducing etc. In the human reproductive process all this acts of the female are considered to be strong stimuli for initiation of sexual intercourse and if the stimuli are not legally prohibitted, it naturally follows that the male's response for the stimuli made by the female, should also be exempt from law and punishment.In fact,the sexual stimuli in such cases, tantamount to inciting what may turn out to be a crime later. Now let us examine the legal provisions relating to the responses moves/responses of the male for these stimuli presented by the female: MALE MOVES /RESPONSES THAT MAY ATTRACT LEGAL ACTION ! - The human male is programmed to be attracted by the females right from the very moment of their birth.First they are attracted by their mother, her breastfeeding,her love and hugging .As the male grows into an adolescent ,his sexuality matures .His attraction for the female grows by leaps and bounds instantly and he is programmed in his mind to seek a female partner for sex and life partnership. At this stage, each male thinks out his own strategy for reaching out to a beautiful female of his choice.His first move usually is (a) looking at her repeatedly .
After sometime, he gathers the courage(b) to approach the girl and open a conversation just to strike a friendly relationship .He tries talking to a girl in a casual manner so that his intentions are not quite explicit.For achieving this end, sometimes a male may be (c) following a female for a few days together. Different cultures of mankind have different way of man meeting a woman for the purpose of marriage.In western culture ,courting and dating are approved ways . In Indian culture,the Hindu caste system mostly decides the marriages, the main condition is that the man and the woman should belong to the same caste.Otherwise, there will be lot of parental as well as social resistance,sometimes going up to the level of cruel murder of son/daughter,by the own family itself !Apart from these caste restrictions,depending on each ethnic/linguistic community, the man- woman meeting could be in different formats .Since India has a variety of castes and communities,the approach is also equally variegated. LEGAL POSITION:As per the extant provisions of the Indian law on protection of children and women in various acts,the following points have to be noted: (a)Looking at a girl- This simple action may attract the offence of Voyeurism covered under section 77 of the BNS Act 2023 and is punishable upto 7 years in jail !That means, the very first natural move of a male to approach a female for building a relationship is punishable under Indian law! So,every Indian male risks a jail term for just approaching a girl !Moreover, the girls are encouraged to complain against any boy approaching them.Popular media highlights such incidents and glorify the girls who makes complaint against boys with the police !With the result every poor Indian who approaches a woman has to venture it in constant fear !What a pitiable condition! (b) to approach the girl- Approaching a woman for furthering the courting process may attract the provisions of section 75 of the BNS which covers sexual harassment .Thus,strange it may sound but man approaching woman for courting is also in a way prohibited by the Indian law. (c) following a female-Following a woman repeatedly is termed as stalking and is punishable under section 78 of the BNS Act.Following a woman repeatedly is to win her heart and that is quite a natural way in love-making.First ,the woman may be against the man who follows but later through repeated moves ,the man tries to convince the woman to accept him and she may end up accepting him.This is the natural way of building a love relationship.However, Indian law does not permit this and every man has to risk the law to win a girl ! Now let us suppose that an Indian man heroically risks his life and wins over a girl successfully!They together decide to have a nice time in the bed and have (d)consensual sex .Getting a place for consensual sex in India is very difficult as the hotels do not generally permit unmarried boy and girl to stay together in a room.Many obstacles are placed on the way if one tries to have sex in a park or a hidden public place .Let's say all this obstacles are won over by our hero! Now,what does Indian law say about this consensual sex?Though consensual,Section 69 of BNS Act 2023 criminalises sexual intercourse obtained through deceitful means,like by making a false promise to marry without the intent to fulfill it, or through fake promises of employment, promotion, or hiding one's identity.Thus,this section effectively empowers the woman involved to falsely accuse the man,after the sex is over with the consent.She can freely claim that he promised to marry which fact can never be proved or disproved in a court of law !Consequently,(d)consensual sex is also placed beyond a man's reach by the Indian law ! - CONCLUSION:The fore-going deep analysis clearly establishes that the Indian law is against sex and reproduction and is highly biased especially against the men who are supposed to lead the reproduction process of mankind.It is high time a gender neutral law regarding sex and reproduction is brought into legislation ,so that the men need not be scared legally to carry on their natural reproductive obligations and urges.Yes,it's time for men's liberation from the clutches of law !
